What Goes Into an Offer to Purchase?
An Offer to Purchase (also called an Agreement of Purchase and Sale in Ontario) is a legally binding document. Every term matters. Here is what we negotiate together:
Purchase Price
I prepare a Comparative Market Analysis (CMA) before any offer is submitted. This tells us what similar homes have actually sold for in the area — not asking prices, but real sale prices. We use this to craft a number that is competitive but not reckless.
Deposit
In Ontario, a deposit accompanies the offer as a show of good faith. Typically 1% to 5% of the purchase price, due within 24 hours of acceptance. This is held in trust by the brokerage and applied to your purchase price at closing — it is not an extra cost.
Conditions
Conditions protect you. The most common are: financing condition (gives you time to confirm your mortgage), home inspection condition (gives you time to have the home inspected), and sometimes a status certificate review for condos. Conditions are negotiable — I advise you on which ones you need and when it might be appropriate to structure them differently.
Closing Date
This is the date you take possession. In the Ottawa Valley, 30 to 90 days is typical. Military buyers often need closing dates to align with their posting date. I negotiate closing dates that work for your specific situation, not just the seller’s preference.
Inclusions and Exclusions
What stays and what goes? Appliances, window coverings, fixtures, and sometimes hot tubs or sheds can be negotiated as inclusions. If something matters to you, we put it in the offer.
